Public register
Section 14 of the Food and Environment Protection Act (Part II) requires the licensing authority to maintain an up to date register of details relating to applications received and consents issued for consultation by the public.
The type of information to be held within the Register has been widened by new provisions contained in the Environmental Protection Act of 1990.
Regulations implementing the provisions of Section 147 of the Environmental Protection Act 1990, amended by FEPA so as to extend the information held in the Public Register substantially, came into force on 1 July 1996.
The Regulations ensure that almost all the information provided in support of an application, details of the licence granted (or reasons for its refusal) and data accrued during inspection and monitoring of a licensed operation are available on the Public Register.
Requests to inspect the Register or for information should be directed to the Marine Works and Consents Unit. (A charge may be made for copies of data provided.)
Certain data may be withheld from the Public Register with the consent of the licensing authority where its inclusion would be liable to compromise national security or prejudice commercial interests to an unreasonable degree.
However, access to environmental and other information held by the Unit may be required in compliance with our obligations under the Freedom of Information Act 2000, the Environmental Information Regulations 2004 and the Data protection Act 1998.
